Heard Ms. Amulya Jain, Advocate holding brief of Ms. Mahima Maurya Kushwaha, learned counsel for the petitioner and perused the record.

The petitioner has preferred the present writ petition inter-alias with the prayer to direct the Respondent No. 1/ Presiding Officer, Labour Court, Agra to decide Misc. Case No. 10 of 2016 (Govind Singh vs. Chairman, Nagar Panchayat, Purdil Nagar, Hathras (Mahamaya Nagar) & Another), within stipulated period.

It is argued that though the Presiding Officer, Labour Court, Agra in Misc. Case No. 10 of 2016 filed by the petitioner under Section 33-C (2) of the U.P. Industrial Dispute Act, 1947 read with Section 6-H (2), issued a notice on 16.02.2016. It is argued that inspite of the fact that considerable time has already been lapsed but till date no final decision has been taken.

From perusal of the order sheet it transpires that large number of cases were fixed from time to time but till date no final decision has been taken.

From perusal of the record, it is clear that petitioner suffering irreparable loss due to negligence by the Presiding Officer, Labour Court, Agra.

In this view of the matter and also in the interest of justice, the present writ petition is disposed of finally directing the Respondent No. 1 namely Presiding Officer, Labour Court, Agra to decide the aforesaid misc. case strictly in accordance with law, expeditiously and positively within a period of two months from today, unless there is no legal impediment.

Registrar (Compliance) is directed to communicate the copy of this order to the Presiding Officer, Labour Court, Agra through District Magistrate, Agra within a week.
