Heard learned counsel for the petitioners, Shri Arvind Kumar Singh, learned Standing Counsel for the State-respondents, and perused the records.

The petitioners have filed the instant petition seeking protection from the police as they have solemnized marriage against the wishes of their parents.

On the last day of the hearing, the Court sought a verification report regarding the legitimacy and genuineness of the documents filed along with the petition.

Learned Standing Counsel, on the basis of instructions, states that earlier petitioner no.1-Smt. Sandhya Verma was married to one Saurabh Kumar and without divorcing her previous husband, she has solemnized her second marriage with petitioner no.2Nishant Kumar. Learned Standing Counsel further states that in the instant writ petition the petitioners have stated that this is first marriage of the petitioners but this is second marriage of petitioner no.1-Smt. Sandhya Verma, therefore, the petitioners have approached this Court seeking protection by concealing the material facts, hence the present writ petition deserves to be

dismissed with cost.

Since the petitioners have approached this Court seeking protection by concealing the material facts, the instant writ petition is dismissed with cost of Rs.25,000/- to be deposited by the petitioner no.2-Nishant Kumar before the District Legal Services Authority, Varanasi, within a period of thirty days from today, failing which, the District Magistrate, Varanasi is at liberty to recover the said amount as arrears of land revenue. The District Magistrate, Varanasi shall submit its report within fifteen days, thereafter before the CJM, Varanasi. The CJM concerned, shall submit its report thereafter to this Court to be kept on record of this writ petition.

Let a copy of this order be sent to the District Magistrate, Varanasi, for information and necessary compliance.
