Heard learned counsel for the petitioner and learned Standing Counsel for State-respondents.

The petitioner by means of the present petition has prayed for the following relief:-

"(i) Issue a writ, order or direction in the nature of mandamus directing to the respondent No.3/ District Magistrate, Ghazipur restore the pillar and boundary wall of petitioner situated in plot no.272K area 0.0010 Hectare in Village Arsadpur, Tehsil Sadar, District Ghazipur.

(ii) Issue a writ, order or direction in the nature of mandamus directing to the respondent No.3/ District Magistrate, Ghazipur to take legal action against area Revenue Inspector Laxmi Singh and her husband Amod Singh (Lekhpal) and SubInspector Lallan Rajbhar Police Station Jangipur District Ghazipur who have illegally demolished Pillar and boundary wall of petitioner.

(iii) Issue any other suitable order or direction which this Hon'ble court may deem fit and proper under the facts and circumstances of the case.

iv. Allow the petition with cost."

On a pointed out query being raised as to why respondent nos. 10 to 19 have been impleaded as respondents in the writ petition, learned counsel for the petitioner states that a civil suit has been instituted by the petitioner against some of the private respondents. From the perusal of the

writ petition, it appears that there is a private dispute between petitioner and private respondents which has been given colour of a dispute with public authority so as to seek a direction under Article 226 of the Constitution of India from this Court.

Since the dispute is essentially a private dispute between the petitioner and private respondents, therefore, the writ petition is not an appropriate remedy.

In such view of fact, we are not inclined to grant relief as prayed for by the petitioner.

Accordingly, writ petition lacks merit and is hereby dismissed with liberty to the petitioner to avail appropriate remedy available under the law in respect to his grievance.
