This writ petition has been filed with the following prayer:-

"(i) issue a direction to the Presiding Officer/Motor Accident Claim Tribunal, Saharanpur to decide the delay condonation application (under section 5 of Limitation Act) in Misc. case No. 96 of 2024 (Urmila Devi & others vs. Shahid & another) under section 166/140 Motor Vehicle Act, Pending in the court of Presiding Officer/Motor Accident Claim Tribunal, Saharanpur, within stipulated time."

It is contended by learned counsel for the petitioner that application to condone the delay in filing Misc. Case No. 96 of 2024, under Section 5 of Limitation Act is pending consideration. The sole prayer made is for expeditious disposal of the same.

As no useful purpose would be served in keeping the matter pending, the writ petition is being disposed of, at the admission stage, without calling for counter affidavit or issuing notice to private respondents, with a direction upon tribunal concerned to decide the decide the delay condonation application (under section 5 of Limitation Act) in Misc. Case No. 96 of 2024 (Urmila Devi & others vs. Shahid & another), in accordance with law, after hearing all affected parties, preferably within a period of three months from the date of production of certified copy of this order.

With the aforesaid directions, writ petition stands disposed of.

It is made clear that this Court has not adjudicated the matter on merits.
