Heard Sri Hom Narayan Awasthi, learned counsel for the petitioner and Sri Neel Padm Dhar, learned Standing Counsel for the state.

The instant petition has been filed seeking a direction in the nature of mandamus commanding opposite party Nos.1 to 3 to ensure compliance of order dated 18.11.2023 passed by Assistant Collector in Case No. 520 of 2019 under Section 67 of U.P. Revenue Code, 2006 and evict opposite party No.4 from Gata No. 65/0.020 hec. with immediate effect.

At the very outset, learned Standing Counsel states that the order dated 18.11.2023 passed by the Assistant Collector had been challenged by respondent No.4 before appellate authority and appeal was dismissed in the year 2025. Thereafter, for execution of order dated 18.11.2023, notice has been issued to respondent No.4. Therefore, no cause of action arising for filing the present petition.

At this stage, learned counsel for the petitioner submits that a direction may be issued for expeditious execution of the order dated 18.11.2023.

In view of the above, the petition is disposed of with a direction to the concerned authority to expeditiously execute the order dated 18.11.2023 passed under Section 67 of the U.P. Revenue Code, 2006, if there is no legal impediment.
