Heard Shri Manoj Kumar Gupta, learned counsel appearing for the petitioner and learned Standing Counsel appearing for the respondents.

The captioned writ petition has been filed challenging the order dated 15th February, 2008 passed by the District Magistrate, Sant Kabir Nagar, whereby the general directions have been issued to the authorities not to entertain any compliant filed by the petitioner.

It has been argued on behalf of the petitioner that there is no such provision under any law, under which the District Magistrate, Sant Kabir Nagar can pass such an order thereby restraining the authorities from entertaining any complaint filed by the petitioner.

Learned Standing Counsel appearing for the State, on being confronted, could not point out any provision under any law, which authorizes the District Magistrate to pass such an order.

We have considered the arguments advanced by the learned counsels appearing for the parties and we find that there is no provision under which District Magistrate, Sant Kabir Nagar can pass a blanket order, thereby directing the authorities of the district not to entertain any complaint filed by the petitioner. We also find that by means of the directions issued under the order impugned in this writ petition, the valuable rights of the petitioner have been infringed including his

fundamental rights guaranteed under Articles 19 and 21 of the Constitution of India.

In view of the aforesaid reasons, the order dated 15th February, 2008 passed by the District Magistrate, Sant Kabir Nagar is hereby quashed.

Accordingly, the writ petition is allowed.
