The restoration application is pending in this case since the year 1986. In the report dated 16.12.2024, which is, in fact, in the form of instructions given to the learned Standing Counsel, all that is there for an explanation is an eyewash.

The order-sheet aforesaid shows consistent adjournments all on irrelevant causes, except for sometime on account of the CoViD-19 lock-down. Most of the adjournments are labelled as "General Date" (ससमसनयततथथ) or the Presiding Officer being engaged with administrative duties. There are some adjournments which have been eventlessly made, honouring something declared illegal by the Supreme Court, that is to say, call for a strike by the Bar Association. All kinds of strike by the Bar are illegal, in view of the law laid down in Ex-Capt. Harish Uppal v. Union of India and another, (2003) 2 SCC 45, Common Cause, a registered society and others v. Union of India and others, (2006) 9 SCC 295, Krishnakant Tamrakar v. State of Madhya Pradesh, (2018) 17 SCC 27, District Bar Association, Dehradun through its Secretary v. Ishwar Shandilya and others, (2020) 17 SCC 672 . The order-sheet clearly reflects that the Presiding Officers, who were incumbent, have indulged in dereliction of duty and prima facie , deserve to be proceeded with against by the State Government in their disciplinary jurisdiction.

However, before any further orders are made, let the Settlement Officer of Consolidation, Kushinagar show cause in the matter why for the period of his incumbency, during which there is culpable inaction on his part, appropriate orders be not made, recommending disciplinary action against him by the State. He shall cause show in the matter by filing his personal affidavit by the date next scheduled, without fail.

Let the Collector/District Deputy Director of Consolidation indicate in his affidavit names of incumbents in the Office of the Settlement Officer of Consolidation during the period of time that this restoration has remained pending and is still pending. Their details with their present posting shall be furnished to this Court. The Collector, as the District Deputy Director of Consolidation, will also show cause why he did not take remedial steps in the matter and chose to remain discreetly silent about all this inaction by an officer subordinate in the consolidation jurisdiction. The Collector's affidavit shall be, again, his personal affidavit, shall also be filed by the date next fixed.
