And 3 Others, decision dated December 15, 2025: Finding the instructions sent by the authorities 'not proper', the Court held that the proceeding initiated under Rule 109A of the U.P.C.H. On 13.11.2025 following order was passed by this Court:-

"1. Learned counsel for petitioners submitted that in pursuance of the final order passed by this Court in allotment of Chak proceeding, application under Rule 109 of the U.P.C.H., Rule was filed before the Consolidation Officer, but till date the proceeding has not been registered.

2. Sri Sharad Chandra Singh, learned Additional Chief Standing Counsel for the State shall obtain instructions from respondent no. 2- Consolidation Officer within two weeks as to why the proceeding has not been registered till date by the Consolidation Officer.

3. Put up this matter as fresh on 28.11.2025."

The instructions sent by the authorities is not proper as the proceeding initiated under Rule 109A of the U.P.C.H. Rules is to be registered and proper order should be passed by the authority, rather to say that if, any order is passed for compliance of the order passed by this Court that will create complication in view of pendency of other writ petition relating the allotment of chak.

Considering the facts and circumstances of the case, Consolidation Officer is directed to register the proceeding under Rule 109A of the U.P.C.H. Rules and pass the proper order in the matter.
