Heard learned counsel for the petitioners, Shri Hemant Kumar Pandey, learned Standing Counsel for the State/respondent No.1 and perused the record.

By means of the present petition, the petitioners have sought following main relief (s) :-

"(a) issue an appropriate writ, order or direction in the nature of certiorari, quashing the impugned order dated 05.04.2025, passed by the Deputy Director of Consolidation, District Barabanki, opposite party no. 1, dismissing the application of the petitioners under section 48(3) of the U.P. Consolidation of Holdings Act, 1953, and rejecting the reference case no. 0555/2024, Computerized No. 202454041200000555 (Awadh Ram and others versus State of U.P. and others), vide annexure no. 1."

In view of various pronouncements on the issue including the judgments passed in the case of Ram Bahadur and Ors. Vs. Deputy Director of Consolidation, Amethi, 2023 159 RD 540, Pateshwari Dutt Pandey Vs. Deputy Director of Consolidation, Faizabad and others, 2015 (129) Rev Dec 4, Sripal & two others Vs. D.D.C. Raebareli & 4 others, 2017 (137) Rev Dec189, Bhunesh Dutt and others Vs. Joint Director of Consolidation and others, 2015(126) RevDec 525, Bhagwat Prasad Vs. State of U.P. and two others, 2015 (126) RevDec 666 and Gafoor Vs. Additional Commissioner, Lucknow and others, 1979, RD 76, after publication of notification under Section 52 of Consolidation of Holdings Act, 1953 (in short "Act of 1953"), the power could not be exercised by the authorities under the Act of 1953, this Court is not inclined to entertain the instant petition. Accordingly, it is dismissed for the reason that after publication of notification under Section 52 of Consolidation of Holdings Act, 1953 (in short "Act of 1953") the power could not be exercised by the authorities under the Act of 1953.

Accordingly, the writ petition is dismissed.
