Shatromati versus Smt. Umapati Devi); (ii) quashing of the pending revision proceeding itself; and (iii) Mandamus commanding the Sub Divisional Officer, Tehsil Sadar, District Gonda to expeditiously decide pending Appeal Case No. 15786/2024, Computerized Case No. T202408300415786 (Smt. Umapati Devi versus Smt. Shatromati). On being confronted with the facts — the impugned Board order having been passed in a revision challenging the Appeal Authority's (Sub-Divisional Magistrate, District Gonda) order dated 28.10.2024 in Appeal No. 15786 of 2024, whereby the Appellate Authority had entertained the appeal and rejected the private opposite party's application seeking rejection of the appeal on account of non-impleadment of a necessary party — and taking note of this Court's observations in various pronouncements including the judgment dated 15.02.2023 in Writ B-778 of 2022 (Jagdish Prasad vs. State of U.P. and Others), counsel for the petitioner conceded that justice would suffice if the petition were disposed of with a time-bound direction; this was not opposed. Notice to private respondent No. 6 was dispensed with. Without interfering in the impugned order(s) and expressly without examining merits, the Court disposed of the petition, directing the Board of Revenue, U.P., Lucknow to consider and decide the pending revision most expeditiously, after affording full opportunity of hearing and without granting unnecessary adjournments, preferably within six months from the next date fixed in the case, if there is no other legal impediment, the Authority remaining free to decide strictly in accordance with law.
