Allahabad High Court (Sudhanshu Chauhan, J.), by order dated October 29, 2025 in Writ-B No. 2891 of 2025 (Vidaydhar Alias Mannu v. Consolidation Officer and 5 others), disposed of a petition seeking mandamus for expeditious decision of a pending consolidation restoration case. Noting that instructions called for vide order dated 06.08.2025 (reminder letter dated 8.08.2025) had not been received, and without entering into the merits of the controversy, the Court directed the Consolidation Officer, Sadar, Jaunpur to decide Case No. 2619 (Anand Kumar & Ors. v. Heard learned counsel for the petitioner and learned standing counsel appearing for the State-respondents.

The present writ petition has been filed by the petitioner seeking following relief:

"(i) Issue a writ order or direction in the nature of mandamus directing to the Respondent No.-1 Consolidation Officer Sadar, Jaunpur to decide the Restoration dated 30.09.2021 (Annexure No.2 to this writ petition) pending in case no. 2619 a proceeding under section 9A(2), of U.P. Consolidation of Holdings Act, 1953 is pending before him expeditiously within stipulated period. So, justice may be done."

This Court vide order dated 06.08.2025 had directed the learned standing counsel to obtain instruction in the matter.

Learned standing counsel has informed that despite issuance of letter dated 8.08.2025, no instructions have been received till date in the matter.

In view of the aforesaid, no useful purpose would be served in keeping the writ petition pending.

Without entering into the merits of the controversy, the Respondent No.1/Consolidation Officer Sadar, Jaunpur is directed to decide the Case No. 2619 (Anand Kumar & Ors. Vs. Sunil Kumar & Ors.) under Section 9A(2) of U.P. Consolidation of Holdings Act, 1953 on merits after giving an opportunity of hearing to the parties concerned in accordance with law expeditiously say preferably within a period of four months from the date of production of certified copy of this order.
