Heard learned counsel for petitioner and learned State Counsel appearing on behalf of the opposite parties.

Present petition under Article 226 of Constitution of India has been filed challenging order dated 07.05.2025 passed by Tehsildar concerned whereby petitioner's income certificate has been cancelled.

Mr. Jogendra Nath Verma, learned State Counsel has raised a preliminary objection regarding maintainability of this petition in view of fact that petitioner has an alternative remedy of filing an Appeal before the SubDivisional Magistrate in terms of Schedule to U.P. Janhit Guarantee Adhiniyam, 2011.

Upon such objections being raised, learned counsel for petitioner seeks liberty to approach the appellate authority.

Considering aforesaid facts, liberty is granted to petitioner to file an Appeal against impugned order before Sub-Divisional Magistrate concerned who shall consider and decide the same expeditiously, in accordance with law, preferably within a period of six weeks from filing of Appeal by petitioner along with a certified copy of this order.

With aforesaid direction, the petition stands finally disposed of .
