Heard Sri Parvat Singh, learned counsel for the petitioner, learned Standing Counsel for the State-respondent No. 1 and Sri Harshit Pandey, learned counsel counsel for the respondent no. 2.
The petitioner claims that she is entitled to benefits of Assured Career Progression (ACP). She has made a representation in this regard but to no avail.
Learned counsel for the respondents submit that the matter requires determination of facts by the competent authority as per law in the first instance. However, they fairly contend that her claim for ACP benefit is liable to be decided by the competent authority in a reasonable time frame.
In light of the aforesaid submissions and without going into the merits of the case, the respondent no.2-Nagar Ayukta, Nagar Nigam, Kanpur Nagar is directed to decide the representation of the petitioner regarding ACP benefits as per law within a period of three months from the date of receipt of a certified copy of this order along with a fresh
copy of the representation.
With the aforesaid direction, the writ petition is finally disposed of.
