Hon'ble Abdul Moin,J.

1 . Shri Aman Pandey, Advocate at the very outset submits that although the Division Bench vide order dated 03.07.2025 had directed the petitioner to expunge the relief Clause III yet as the relief clause IV was a consequence to the relief clause III, as such the petitioner without taking liberty of this Court has also deleted the relief Clause IV. He expresses his unconditional apology for the same. His apology is accepted.

2 . As per the learned counsel for the petitioner the Relief Clause IV is in consequence to Relief Clause III. As Relief Clause III had been deleted as such there is no occasion for the relief Clause IV.

3 . Learned counsel for the petitioner is required to be more careful in future.

4 . Heard Shri Aman Pandey, learned counsel for the petitioner, learned Standing Counsel for respondent-State No.1 and Shri Arun Kumar Singh holding brief of Shri Rishab Tripathi, learned counsel appearing for respondents No.2 to 4.

5 . With the consent of the parties, the matter is being decided finally. 6 . Although under challenge is the suspension order dated 17.05.2025 and the charge-sheet dated 21.05.2025, copies of which are Annexures 1 & 2 to the petition, yet learned counsel for the petitioner confines his prayer to the departmental enquiry being conducted within specified time. To the aforesaid prayer, learned counsel for the respondents have no objection.

7 . Accordingly, taking into consideration the aforesaid fact, it is provided that the petitioner shall submit his reply to the charge-sheet within seven days. After submission of the reply, the respondents shall finalize the disciplinary proceedings against the petitioner and the disciplinary authority shall proceed to pass a final order within a further period of six weeks.

8 . Needless to mention that the petitioner shall cooperate with the inquiry proceedings and he shall also be given due opportunity of hearing in the said inquiry proceedings.

9 . In case the petitioner does not cooperate in the inquiry proceedings, the Inquiry Officer would be at liberty to inform the petitioner in writing about his non-cooperation and the period of non-cooperation would be excluded from the aforesaid period.

10 . The writ petition stands disposed of .
