In the office report dated 20.02.2025, it is mentioned that undelivered envelope of card notice issued through speed post to the sole petitioner vide Despatch No.1313 dated 12.02.2025 has been received back with remark of postal department ("Recipient does not reside at the given address, hence return to sender").
Though the office has endorsed that notice is not sufficient but the envelope has come back with remark that recipient does not reside at the given address therefore, at this juncture after 21 years, from the date of institution of the writ petition, there is no justification to keep the matter pending.
The case is pertaining to the year 2004 and the petitioner perhaps has lost his interest to pursue the case and he is not contacting either his previous counsel or by either mode to pursue his case therefore, the writ petition has rendered infructuous.
The writ petition is dismissed as infructuous.
Interim order, if any, is discharged.
