Counsel for petitioner is permitted to impleade Chief Medical Officer, Budaun as respondent No. 3 and a copy be served upon learned Standing Counsel during the course of the day he is also directed to correct the details of respondent No. 2.

Heard Shri Ikram Ahmad, learned counsel for petitioner, Shri Bal Mukund, learned counsel appearing for respondent No.2 and learned Standing Counsel.

By means of this petition filed under Article 226 of the Constitution petitioner has payed for a direction upon newly impleaded respondent No. 3 to decide the claim of family pension.

Learned Standing Counsel submits that under the order of the Senior Accounts Officer dated 25.01.2025 petitioner was required to furnish further details of documents and in the event petitioner furnishes the same, the respondent will be taking final action in the matter.

Shri Ikram Ahmad, leaned counsel for petitioner submits that the petitioner has already replied to the letter dated 25.01.2024 by letter dated 30.10.2024 annexing therewith all the requisite documents. The said letter has been sent by registered post but no action has been taken in the matter till date.

Shri Bal Mukund, learned counsel for respondent No. 2 has no objection in case petition is disposed of with the direction to the respondent No. 3 to decide the matter in accordance with law.

In view of the above, this petition is disposed of with the direction to the respondent No. 3 to consider and disposed of the claim of the petitioner within a period of two months from the production of certified copy of this order by means of a reasoned
