Heard learned counsel for petitioner and learned State Counsel for opposite parties.

Petition has been filed seeking a direction to concerned authority to permit petitioner to join on the post of Aganwadi Worker in center Pakdi-2 situate in Gram Sabha Pakdi BlockGaisari, District Balrampur, since petitioner was selected on the said post and appointment letter dated 24.04.2025 was also issued in her favour.

It is submitted that petitioner is not being permitted any joining on the said post on account of cancellation of domicile certificate on 26.10.2024 but the opposite parties have not considered the aspect that petitioner's appeal against the cancellation order is pending consideration and that a fresh domicile certificate has been issued on 05.06.2025, a copy of which was submitted before authorities by petitioner.

Since consideration of petitioner's grievance would entail factual aspects, liberty is granted to petitioner to make a fresh representation before opposite party no.3 i.e. District Programme Officer, Balrampur who shall consider and decide the same in accordance with law within a period of three weeks from the date a certified copy of this order is produced before the said authority. It is also made clear that in case petitioner succeeds in her challenge to the order dated 26.10.2024, her rights of appointment shall be subject to such decision in light of her appointment.

With aforesaid directions, petition stands disposed of.
