Heard Sri Ram Raj, learned counsel for the petitioner, Sri Pradeep Kumar Singh, learned Additional Chief Standing Counsel for the opposite party no. 1 and Sri Aditya Mohan, who has filed his vakalatnama on behalf of opposite party nos. 2 and 3 and the same is taken on record.
Since, the opposite party no. 4 is a departmental promotion committee constituted by the opposite party no. 1, therefore, the instructions on behalf of that opposite party may be sought by Additional Chief Standing Counsel.
By means of this petition, the petitioner has prayed the following reliefs:-
"i. Issue a writ, order or direction in the nature of Certiorari quashing the impugned order dated 10.01.2025, passed by the opposite party no. 1/ State Government, contained in Annexure No. 1 to this writ petition, whereby Departmental Promotion Committee for Promotion to the post of Joint Director (Construction) from Deputy Director (Construction) was constituted for 17.01.2025 at 06:00 pm.
ii. Issue a writ, order or direction in the nature of Certiorari quashing the impugned minutes of the Departmental Committee Promotion dated 17.01.2025, sent by the opposite party no. 1 vide its letter dated 27.01.2025 to the opposite party no. 3/Director, after summoning the original from the custody of the opposite party no. 1/State Government or opposite party no.4/ Departmental Promotion Committee.
iii. Issue a writ, order or direction in the nature of Certiorari quashing the entire proceedings undertaken by the opposite parties 1 to 3 subsequent to the impugned recommendation of the opposite party no. 4/ DPC, after summoning the originals from the custody of the opposite parties 1 to 3.
iv. Issue a writ, order or direction in the nature of Certiorari quashing the entire Departmental Promotion Committee proceedings (D.P.C held on 17.01.2025) with regard to promotion of Joint Director (Construction) from Deputy Director (Construction).
V. Issue a writ, order or direction in the nature of mandamus commanding the opposite parties not to give effect to the operation and implementation of the impugned orders dated 10.01.2025, 17.01.2025 and the entire
Departmental proceedings (D.P.C held on 17.01.2025)"
Let the counter affidavit be filed within a period of four weeks.
Rejoinder affidavit be filed within one week.
List int he week commencing 14.07.2025, as fresh.
The matter may be taken up immediately after fresh.
When the case is next listed the name of Sri Aditya Mohan shall be printed in the cause list as counsel for the opposite party nos. 2 and 3.
