Shri Mohd. Umar Khan, learned counsel for the petitioner and learned Standing Counsel for the State is present. No one appears on behalf of the Mandi Parishad.
Mohd. Umar Khan, learned counsel for the petitioner contends that the petitioner is entitled to be promoted to the post of Mandi Inspector. A representation in this regard has been made to the competent authority but to no avail.
Shri Subhranshu Shekhar, learned Additional Chief Standing Counsel submits that the matter requires factual determination and other considerations as per applicable laws by the competent authority in the first instance. However, he fairly contends that the claims for promotion are liable to be decided by the competent authority in a reasonable time frame.
In light of the submissions made at the Bar and without going into the merits of the case, the respondent no. 2 - Director, Rajya Krishi Utpadan Mandi Parishad, U.P. is directed to decide the claim of the petitioner for promotion as per law within a period of three months from the date of
receipt of a certified copy of this order along with a fresh copy of the representation.
With the aforesaid direction, the writ petition is finally disposed of.
