Heard Sri Pushpendra Kumar Sharma, learned counsel for the petitioners and Ms. Deepshikha, learned Chief Standing Counsel-II for the State-opposite parties.

The present petition under Article 226 of the Constitution of India has been filed seeking a writ in the nature of Mandamus commanding and directing the opposite parties to send back the petitioners from their attachment place i.e. U.P. Dial-112 Project, District Barabanki, Banda and Lalitpur to their parent Department i.e. P.A.C.

Learned counsel for the petitioners submits that the petitioners have completed more than 3 years of their posting at Dial 100/112. He further submits that as per the relevant Government Order issued in this respect, police personnel posted at Dial 100/112 should not remain posted for more than 3 years. It is further submitted that letters have been written by the competent authority for posting police personnel, who have completed more than 3 years of their posting at Dial 100/112, to some other place but the petitioners have not been relieved from their present place of posting to be posted elsewhere.

Learned counsel for the petitioners submits that the petitioners may be given liberty to approach respondent No.2 for taking appropriate action relieving them from their present place of posting and post him elsewhere.

Considering the aforesaid submission, present writ petition is disposed of with liberty to the petitioners to approach the competent authority i.e. Additional Director General of Police (Establishment) D.G.P. Headquarter, Lucknow U.P. (respondent no. 2) for relief of posting them out from Dial 100/112, who should consider the grievance of the petitioners and pass appropriate order within a period of two months from the date petitioners approach him for the relief sought in the writ petition.
