Heard learned counsel for the petitioner, Mr. Subham Tripathi, learned counsel for respondent nos. 1 to 3, learned Additional Chief Standing Counsel for the State and perused the record.

Instant petition has been filed with the following reliefs:-

"i. To issue a Writ, Order or Direction in the nature of Mandamus commanding the Respondent No. 3, to forward the pension documents of Petitioner to the Respondent No. 4 for disbursement of family pension and death-cum-retirement gratuity to the Petitioner, copy whereof is contained as Annexure-10 to this Writ Petition;

ii. To issue a Writ, Order or Direction in the nature of Mandamus commanding the Respondent No. 4, to issue pension payment order for disbursement of family pension and death-cum-retirement gratuity to the Petitioner;

iii. To issue a Writ, Order or Direction in the nature of Mandamus commanding the Respondent No. 3, to pay interest to the Petitioner at the rate of 18% per annum on the delayed payment of family pension and death-cum-retirement gratuity of her late husband from the date on which it became due i.e., on 27.03.2020 till the date of actual payment to the Petitioner;

iv. To issue such other Writ, Order or Direction which this Hon'ble Court may deem fit and proper for protecting the rights and interests of the Petitioner under the circumstances of the case;

v. Award the costs of the Writ Petition in favour of the Petitioner."

After arguing at length, learned counsel for the petitioner submits that the interest of justice would be sub-served if this Hon'ble Court may be pleased

to give liberty to the petitioner to move a fresh representation before the respondent no. 3 and he may be directed to consider & decide the same, within stipulated period of time as may be fixed by this Court.

Learned counsel for the opposite parties have no objection to the contention aforesaid.

Be that as it may, without entering into the merit of the case, the petitioner is permitted to move a fresh representation within period of 15 days, and if such representation is moved within aforesaid period, the respondent no. 3/Registrar, King George's Medical University, is hereby directed to consider and decide the same, within a period of two months, in accordance with law, from the date, a certified copy of this order is produced before him.

With the aforesaid observations, the instant petition is disposed of.
