Writ - A No. 4185 of 2025, High Court of Judicature at Allahabad, Lucknow Bench (Court No. 3), decided 24.4.2025 by Hon'ble Rajesh Singh Chauhan, J. The petitioner, Dr. Richa Yadav, prayed for mandamus commanding the opposite parties, especially opposite party Nos. 1 and 3, to issue/grant a No Objection Certificate enabling her appearance in the interviews for the posts of Assistant Professor and Associate Professor, Department of Pathology, at Dr. Ram Manohar Lohiya Institute of Medical Sciences, Lucknow, in pursuance of Advt. Nos. Dr. RMLIMS/ER/Reet-F(R)/2025/284 and Dr. RMLIMS/ER/Reet-F(R)/2025/288. Interim orders dated 08.04.2025 and 09.04.2025 (in connected Writ-A No.3647 of 2025) and dated 18.04.2025 (in the present matter) recorded the opposite parties' assurance that the petitioner would be permitted to appear in the interview with the No Objection Certificate and that a proper decision on its issuance would be taken expeditiously. Heard learned counsel for the petitioner, Dr. Uday Veer Singh, learned Additional Chief Standing Counsel for the Stateopposite party Nos.1 & 2, Sri Ran Vijay Singh, learned counsel for the opposite party No.3 and Sri Gagan Katyayan, learned Advocate holding brief of Ms. Pushpila Bisht, learned counsel for the opposite party No.4.

2. This Court has passed the order date 18.04.2025, which reads as under:-

"1. Heard Sri Ajay Sharma, learned counsel for the petitioner, Dr. Uday Veer Singh, learned Addl. Chief Standing Counsel for the State- opposite parties no.1 & 2, Sri Ran Vijay Singh, learned counsel for opposite party no.3 and Ms. Pushpila Bisht, learned counsel for opposite party no.4.

2. Attention has been drawn towards the order dated 09.04.2025 passed by this Court in Writ-A No.3647 of 2025, which reads as under:-

2. This Court has passed an order dated 08.04.2025 which reads as under:-

"1. Heard Sri Ajay Sharma, learned counsel for the petitioner, Sri Uday Veer Singh, learned Addl. Chief Standing Counsel for opposite parties No. 1 & 2, Sri Ran Vijay Singh, learned counsel opposite parties No.3 and Ms. Pushpila Bisht, learned counsel for opposite party No.4.

2. By means of this petition, the petitioner has prayed following reliefs:

"(i) Issue a writ, order or direction in the nature of mandamus commanding the opposite parties especially to the opposite party No. 1 and 3 to issue/ grant No Objection Certificate to the petitioner for appearing in the interview (both) for the post of Assistant Professor and Associate Professor, Department of Pathology at Dr. Ram Manohar Lohiya Institute of Medical Sciences, Lucknow in pursuance of Advt. No. Dr. RMLIMS/ER/ Reet- F(R)/2025/284 AND Advt. No. Dr. RMLIMS/ER/Reet-F(R)/2025/288.

(ii) Issue a writ, order or direction in the nature of mandamus commanding the opposite parties to permit the petitioner to appear in interview (both) for the post of Assistant Professor and Associate Professor, Department of Pathology at Dr. Ram Manohar Lohiya Institute of Medical Sciences, Lucknow in pursuance of Advt. No. Dr. RMLIMS/ER/Reet-F(R)/2025/284 and Advt. No. Dr. RMLIMS/ER/ReetF(R)/2025/288, which are going to be held in the last week of April, 2025."

3. Learned counsel for opposite parties may seek specific instructions regarding paras 9 to 12.

3. Dr. Udai Veer Singh, learned Additional Chief Standing Counsel for opposite parties no. 1 and 2, Sri Ran Vijay Singh, learned counsel for opposite party no.3 and Ms. Pushpila Bisht, learned counsel for opposite party no.4 have stated that they have received the instructions.

4. Ms. Pushpila Bisht, on the basis of written instructions, has stated that presently no date for interview has been fixed and if the petitioner appears before the interview (Board) on the date fixed alongwith No Objection Certificate, he would be permitted to appear in the interview.

5. Dr. Udai Veer Singh and Sri Ran Vijay Singh have also stated on the basis of instructions that the proper decision would be taken in the case of the petitioner strictly in accordance with law with expedition so far as issuance of No Objection Certificate is concerned.

6. Accordingly, list this case on 24.04.2025.

7. This matter may be taken up at 03.30 p.m.

8. In the meantime, opposite parties no. 1 and 3 may do the needful regarding issuance of No Objection Certificate to the petitioner."

3. Learned counsel for the petitioner has stated that this issue is also identical, therefore, opposite parties may be directed to issue 'No Objection Certificate' so that it could be produced before opposite party no.4 at the time of interview.

5. In the meantime, learned Addl. Chief Standing Counsel may seek complete written instructions in the matter."

Dr. Uday Veer Singh, learned Additional Chief Standing Counsel has produced a letter dated 24.04.2025 provided from the office of the Director General of Medical Education and Training, U.P., Lucknow enclosing therewith the No Objection Certificate dated 23.04.2024 issued in favour of the petitioner. The same is taken on record.

4. In the wake of the aforesaid developments, nothing remains to be adjudicated in this writ petition.

5. Accordingly, the instant writ petition is dismissed.
