Heard learned counsel for petitioner and learned State Counsel for opposite parties 1 to 5. No one has put in appearance on behalf of opposite party No.6.

Petition has been filed seeking following relief:-

" [I] issue a writ order or direction in the nature of Mandamus commanding the opp. parties to make payment of 10% G.P.F. amount and Gratuity to the petitioner forthwith and also pay the pension regularly each and every month as and when it falls due along with arrears from the date of his retirement i.e. 31.1.2024 in the interest of justice."

With regard to such grievance, petitioner has already submitted a representation to the authorities concerned but seeks liberty to file a fresh representation. At present learned counsel for petitioner restricts his prayer for a final decision with regard to same.

Considering innocuous prayer made by learned counsel for petitioner and without entering into merits of the case, liberty is granted to petitioner to make a fresh representation before opposite party No. 4 i.e. Assistant Commissioner (A) State Tax Sitapur. In case such a representation is filed, the same is required to be decided expeditiously by a reasoned and speaking order within a period of six weeks from the date a certified copy of this order is produced before the said authority.

In case petitioner is entitled for the said benefit, actual payment thereof shall be ensured within a period of six weeks from the date a certified copy of this order is produced before the said authority.
