Writ - A (High Court of Judicature at Allahabad, Lucknow Bench; Karunesh Singh Pawar, J.). Petitioners were selected as Ayush Medical Officers on 20.04.2021 by District Health Society (DHS) and served on contract during the Covid period; their services ended on expiry of the contract. The respondents thereafter passed an order dated 27.08.2024 providing for appointment of Ayush Medical Officers who had worked during the Covid period; the petitioners claimed eligibility under that order and the order dated 28.10.2024, but respondent No. 4 took no steps towards holding the interview despite a representation dated 26.09.2024 (Annexure No. 7). Learned Standing Counsel did not oppose consideration of the applications. The writ petition was disposed of with a direction to respondent No. 4 to consider and decide the representation dated 26.09.2024 expeditiously, within six weeks of production of a certified copy of the order, in accordance with law, and to communicate the decision to the petitioners.

Heard learned counsel for petitioners as well as learned Standing Counsel for respondent Nos. 1, 3 and 4 and Shri Mohit Chandra, learned Advocate holding brief of Shri Punit Chandra, learned counsel for respondent no.2.

It has been submitted by learned counsel for petitioner that petitioner was selected as Ayush Medical Officer on 20.04.2021 by District Health Society (DHS) and had worked during Covid period on contract basis. After the contact period was over, the services of the petitioner came to an end but it has been stated that subsequently respondents have passed an order dated 27.08.2024 providing for appointment of the Ayush Medical Officers who had worked during Covid period.

The grievance of the petitioner is that despite the petitioners are fully eligible and qualified to be appointed as per the order of Government dated 27.08.2024 as well as 28.10.2024, yet respondent No. 4 has not taken any steps towards holding of the interview so that the petitioners can be recruited and accordingly a prayer has been made in the present writ petition for a direction to the respondents to make appointment of the petitioners on the post of Ayush Medical Officers.

Learned Standing Counsel does not oppose the innocuous prayer made by the petitioners for due consideration of their application in light of the aforesaid submission.

Accordingly, the writ petition is disposed of with a direction to respondent No. 4 to consider and decide the representation dated 26.09.2024 (Annexure No. 7 to the writ petition) expeditiously, say, within a period of six weeks from the date a certified copy of this order is produced before him in accordance with law and communicate the decision to the petitioners.
