Interim order (order dated October 9, 2025) of Shree Prakash Singh, J., Allahabad High Court, Lucknow Bench, in WRIT - A No. - 2033 of 2025 (Smt. Vandana Tripathi v. State of U.P. through Principal Secretary, Department of Irrigation and Water Resources and 2 Others). In compliance with the Court's order dated 08.10.2025, the Director, Local Bodies, U.P., Lucknow joined the proceedings. Sri Brijendra Kumar Singh, learned Additional Chief Standing Counsel, informed the Court that 247 posts were created/approved by the State Government under special circumstances as employees died during the Covid period, heirs of the deceased employees have been appointed in all such posts, and that it was now incumbent upon the U.P. Jal Nigam (Urban) to give appointment to the petitioner on compassionate ground. Mr. Rishabh Kapoor, counsel for opposite party no. 2, submitted that the Corporation is running in a tremendous financial loss and sought a week's time to file a detailed counter affidavit. The Court directed: (i) counter affidavits to be filed by the opposite parties; (ii) counsel for respondent no. 2, along with para-wise reply, to specifically aver whether the Corporation is running in accumulative loss or yearly financial loss; (iii) the Director, Local Bodies, while filing the counter affidavit, also to disclose how many vacancies were sanctioned under the special drive of appointment on compassionate ground; (iv) exemption of the Director's personal appearance; and (v) listing of the matter on 27.10.2025 within the top five cases, as fresh. In-compliance of the order dated 08.10.2025, the Director, Local Bodies, U.P., Lucknow has joined the proceedings.

It has been informed by Sri Brijendra Kumar Singh, learned Additional Chief Standing Counsel that 247 posts were created/approved by the State Government under special circumstances as the employees died during the Covid period. He submitted that in all the posts, the heirs of the deceased employees have been appointed. He added that now it is incumbent upon the U.P. Jal Nigam, (Urban) to give appointment to the petitioner, on compassionate ground

Mr. Rishabh Kapoor, counsel appearing for the opposite party no. 2 submits that the Corporation is running in a tremendous financial loss and thus, it is hard to appoint the petitioner, but he may be given a weeks' time to file a detailed counter affidavit so that he may bring all the financial position before this Court.

Let counter affidavit be filed by the opposite parties.

The counsel for respondent no. 2 along with the para wise reply, shall specifically come with the averments that whether the Corporation is running in accumulative loss or yearly financial loss.
