Learned counsel for the petitioner submits that petitioner has been promoted on the post of Deputy Superintendent of Police by order dated 29.06.2024, however, petitioner is not being permitted to join the aforesaid post.

Learned Standing Counsel on instructions submits that censor entry has been awarded to petitioner on 28.11.2024 and as such the promotion has not been executed.

Learned counsel for the petitioner has drawn attention of the Court to the promotion order which says that if any adverse material is found against the employee prior to the passing of the promotion order i.e. 29.06.2024 then the same would be reported to be headquarters.

Prima facie this Court is of the opinion that if the promotion order has been passed and till the date of passing of the promotion order there was no adverse entry against petitioner then there exist no impediment under law to promote the petitioner, however, the censor entry which has been awarded subsequent to the promotion order, can be considered for subsequent promotions.

Since the order has been passed by respondent no.2 promoting the petitioner, at this stage the matter is being relegated to respondent no.2 to examine the issue, as to why, promotion of the petitioner is not being executed.

The aforesaid issue shall be considered and decided by the respondent no.2-Additional Director General of Police, Administration DGP Headquarters, Uttar Pradesh, Lucknow, after giving opportunity of hearing to the petitioner within a period of three weeks from the date of production of certified copy of this

With the aforesaid observations/directions, the writ petition is disposed of.
