Learned counsel for the petitioner has challenged the order impugned dated 27.10.2025 on the ground that since 0.60 exceeds half, it ought to be rounded off to 1, therefore, one Class-III post should have been filled by way of promotion. The aforesaid issue of rounding off 0.60 to 1 has been dealt with by the Division Bench of this Court in the case of Anoop Mishra vs. State of U.P. and another, Writ-A No.28565 of 2012, decided on 20.12.2013 , wherein it was held that if the quota is to be applied and the figure comes to 0.60, the same, being more than half, should be rounded off to 1. The Hon’ble Apex Court has also decided the same issue in the case of Bhudev Sharma vs. District Judge, Bulandshahr and another, reported in (2008) 1 SCC 233 , wherein it was held that in case the figure comes to more than half, it shall be rounded off to 1. He further submits that in view of the settled position of law, the impugned order is liable to be set aside, and 0.60 has to be treated as rounded off to 1, thereby meaning that one post in the 20% quota out of three posts, has to be filled by way of promotion.
