Heard Mr. Dinesh Kumar, learned counsel for the petitioner, Mr. Adarsh Bhushan, learned counsel for the respondent nos.2 to 4 and learned Standing Counsel for the State-respondents.

A preliminary objection has been raised by learned counsel for respondent Nos. 2 to 4, on the basis of instructions, that pursuant to the order passed by this Court, the claim for payment of post-retiral benefits has already been decided by order dated 05.09.2024. Without challenging that order, the present petition has been filed with a prayer to pay interest on the delayed payment of post-retiral benefits, which amounts to a second writ petition.

On the aforesaid objections, learned counsel for the petitioner prays to withdraw the petition with liberty to file afresh petition challenging the aforesaid order dated 05.09.2024.

Accordingly, this petition is dismissed as withdrawn with the aforesaid liberty.
