Allahabad High Court (Manju Rani Chauhan, J.), WRIT - A No. 16841 of 2025, Shishpal v. State of U.P. and others, order dated November 24, 2025 — Interim order in a writ petition concerning the petitioner's reversion to the post of Safai Karmchari and denial of salary. On instructions, counsel for respondent-Nagar Palika Parishad, Hathras stated that the petitioner, reverted by order of May, 2025, was not found performing Safai Karmchari duties from April, 2025 and hence was not entitled to salary for that period. The Court held that even if the reversion in May, 2025 is accepted, there is nothing on record to show that the petitioner did not perform his duties as Beldar in April, 2025, and that the instructions placed before the Court were not proper. Learned counsel for the respondent-Nagar Palika Parishad, Hathras has passed on instructions in the Court today, which are kept on record.

On the basis of instructions, learned counsel for respondentNagar Palika Parishad, Hathras submits that the petitioner was reverted to the post of Safai Karmchari by order passed in May, 2025, therefore, on the basis of verification, as he was not found performing his duty of Safai Karmchari from April, 2025, therefore, he is not entitled for salary, for the said period.

This Court finds that even if it is accepted that the petitioner was reverted to the post of Safai Karmchari in May, 2025, there is nothing on record to show that he has not performed his duties as Beldar in April, 2025. Accordingly, the instructions as placed before the Court are not proper.
