The petitioner has preferred present writ petition interalia with the following prayers :-

"I. a writ, order or direction in the nature of Mandamus directing the respondent no.2 i.e. District Basic Education Officer, District Kushinagar to pay the arrear which is sumrized a period w.e.f. 1996 to 2001 with interest, whereas working as the Assistant teacher, teaching by the petitioner in above noted institution i.e. Kishan Laghu Madhamik, Vidyalay, Jhanga, District Kushinagar, (Annexure No.1 to this writ petition), accordance with law ithin stipulated period."

A preliminary objection has been raised by learned Standing Counsel that the petitioner has come up before this Court at a belated stage hence present writ petition is liable to be dismissed in view of law laid down by Hon'ble The Apex Court in the case of C Jacob Vs. Director of Geology & Mining and another reported in AIR 2009 S.C.,264.

At this point of time, a prayer has been made by counsel for the petitioner to dismiss present writ petition as not pressed.

Prayer made is allowed.

The writ petition is dismissed as not pressed. It is made clear that no liberty has been granted to the petitioner to file a fresh writ petition on the same cause of action.
