Supplementary affidavit filed today in the Court is taken on record.

Along-with the said affidavit letter dated 24.03.2025 written by the respondent no.7-District Basic Education Officer, Chitrakoot to the respondent no.3- State Project Director, (Samagra Shiksha) Lucknow is also appended in which a request has been made to permit the petitioner to join his post again since after submission of his resignation letter another letter was written by the petitioner on 19.03.2025 for withdrawal of his resignation and in view of the fact that the resignation letter dated 18.10.2024 was not accepted till that date. Taking into consideration the aforesaid fact the letter dated 24.03.2025 was written by the respondent no.7-District Basic Education Officer, Chitrakoot.

It is argued that till date no orders have been passed on the resignation letter submitted by the petitioner but wholly illegally a letter dated 20.08.2025 was written by the same District Basic Education Officer, Chitrakoot to the petitioner stating therein that once Sri Shyam Sunder Singh S/o Ram Naresh has already joined on the post of petitioner on 02.08.2025.

From perusal of the aforesaid two letters it is clear that the self conflict stand has been taken by the respondent no.7-District Basic Education Officer, Chitrakoot.

Sri S. K. Singh, learned counsel for the respondent no.3 placed before this Court the instructions dated 24.11.2025 along-with certain letters, same are also taken on record.

Nothing has been stated in the entire instructions nor any document has been placed before this Court that on which date resignation of the petitioner has been accepted. Moreover, the same could not be accepted after 24.03.2025. Since on the said date, the letter has been written by the respondent no.7-District Basic Education Officer, Chitrakoot to the State Project Director (Samagra Shiksha), Lucknow/respondent no.3 stating the facts that after the resignation petitioner has submitted another letter seeking withdrawal of his earlier resignation letter.

Sri Umesh Chandra Kesarwani, learned counsel appearing on behalf of respondent no.7-District Basic Education Officer, Chitrakoot is directed to file personal affidavit of respondent no.7 regarding the different stand taken by him from time to time, which is clear from perusal of the supplementary affidavit. The respondent no.3-State Project Director (Samagra Shiksha) Lucknow is also directed to file his personal affidavit giving the details on which date resignation letter was submitted and regarding the acceptance of the resignation, if any.
