Heard Sri Umesh Vats, learned Senior Advocate assisted by Sri S.K. Mishra, learned counsel for petitioner and Sri Santosh Kumar, learned Standing Counsel for State at length.

Learned counsel for petitioner has raised various arguments, however, Court is of the view that since now petitioner has already completed 5 years in LT Grade on 28.07.2025, therefore, a legal impediment that he was not considered for promotion on the post of Lecturer (Maths) for want of 5 years experience and the basis of impugned order is now removed and in case vacancy is still available, concerned respondents will proceed to initiate process for filling up said posts by way of promotion and the candidature of petitioner will be considered along with eligible candidates, if any, within a short period.

The Court also takes note of an order dated 21.03.2012 passed by Supreme Court in SLP (C) No. 10113/2007 wherein in similar circumstances, above referred directions were passed.

Writ petition stands disposed of with above observations.
