Heard learned counsel for the petitioners, Shri Nitin Mathur, learned Additional Chief Standing Counsel for the Staterespondents No.1 to 4.

With the consent of the parties, the matter is being decided finally.

No notice be issued to respondent no.5 taking in view of nature of order proposed to be passed.

Contention of the learned counsel for the petitioners is that husband of the petitioner No.1 and father of petitioner Nos.2 & 3, namely Brijesh Pratap Singh, was Associate Professor in a degree college. His gratuity has not been paid.

It is contended that aforesaid aspect of the matter has been considered by this Court in a bunch of writ petitions leading being Writ A No.5724 of 2024 in Re: University College Ret. Teachers Welfare Asso. Lko. and Another Vs. State of U.P. and Others , decided on 01.10.2024, a copy of which is Annexure-11 to the petition. It is prayed that the respondents be directed to consider the claim of the petitioners in the light of the aforesaid judgment.

To the aforesaid prayer, Shri Nitin Mathur, learned Additional

Chief Standing Counsel does not have any objection.

Considering the aforesaid, the writ petition is disposed of. It is provided that respondent No.1 shall consider the claim of the petitioners for payment of gratuity along with interest in terms of the judgment of this Court in the case of University College Ret. Teachers Welfare Asso. Lko. (supra) . Such consideration be done within a period of 8 weeks from the date of receipt of a certified copy of this order.

It is made clear that this Court has not gone into the merits of the claim set forth by the petitioners.
