Heard learned counsel for the petitioner, learned Standing Counsel for the State and Mr. Shubham Tripathi, learned counsel for the S.G.P.GI.

"Heard learned counsel for the petitioner, Mr. Pradeep Kumar Singh, learned Additional Chief Standing Counsel for the State and Mr. Shubham Tripathi, learned counsel for the respondent no.3.

Present petition has been filed with the following prayers:-

"A. To issue a writ, order or direction in the nature of Certiorari, quashing the impugned Office Order dated 07.08.2025 bearing No. ?????-1/2025/2723-25 (ANNEXURE NO. 01), whereby the Petitioner's rightful claim for appointment has been rejected on arbitrary and technical grounds.

B. To issue a writ, order or direction in the nature of Mandamus, directing/commanding the respondent no. 2.to forthwith issue the appointment letter in favour of the petitioner for the post of Staff Nurse, pursuant to Advertisement No. 1/75/Rectt./Autonomous SMC/2022-23, as the petitioner is a duly qualified candidate who has successfully cleared all stages of the selection process, in the interest of justice.

C. Issue a writ, order or direction in the nature of Mandamus commanding the opposite parties to consider the case of the petitioner for appointment and to grant him all consequential benefits from the back date, i.e., from December 2023, when other similarly situated candidates of the same batch were appointed, including arrears of salary, fixation of seniority, and all other consequential service benefits."

In compliance of the order dated 8.7.2025 passed by this Court in Writ-A No.7212 of 2025, Kanchan Kumari Vs. State of U.P. and others, the order dated 7.8.2025 is passed by the respondent no.2, that too after filing of the contempt petition.

Contention of the learned counsel for the petitioner is that the petitioner was selected as Staff Nurse and she has been declined joining on the ground that she did not filled up choice, on portal regarding option of college. He submitted that, in fact, the petitioner had filled the column of choice of institute/college including the districts but probably, the same has not been shown on the website/portal itself and, therefore, the situation arose, wherein even after her selection on the post of Staff Nurse, she could not be given admission. He submitted that the petitioner appearing before the authorities and has also given written letter as well as made oral request while showing the reason but the same has not been considered, thus, she is running pillar to post. Further submission is that the order dated 7.8.2025 is passed in a cursory manner.

On the other hand, Mr. Pradeep Kumar Singh, learned Additional Chief Standing Counsel submits that he will seek detailed instructions in the matter.

In compliance of the aforesaid order, Mr. Pradeep Kumar Singh, learned counsel appearing for the State submits that the petitioner has been called for placing her choice of college; for redressal of her grievance; today itself.

In view of the aforesaid, list this matter on 5th December 2025 in the list of fresh cases. "

In compliance of the order above, Mr. Gyanendra Kumar Singh, learned Standing Counsel, appearing for the State has placed the instructions dated 16.12.2025 before this court, which is taken on record.

Referring the aforesaid, he submits that after due deliberation, the Director General, Medical Education and Training Department, U.P, Lucknow has sought instructions from the Additional Chief Secretary, Government of U.P, for appointment of the petitioner, on the post of Staff Nurse, in autonomous State Medical College, Jaunpur; vide its letter dated 03.12.2025. He submitted that further four weeks' time may be granted so as to make appointment of the petitioner, after seeking the approval from the State Government, as the said procedure will take some time.

In view of the above, list/put up this matter on 08.01.2026, in the list of fresh cases.

It is expected that by then, the appointment of the petitioner shall be made
