Heard Sri Sharad Kumar Srivastava, learned counsel for the petitioner.
This writ petition has been filed with the following prayer :-
(i) Issue a writ, order or direction in the nature of Certiorari quashing the Judgment of Central Administrative Tribunal, Lucknow Bench, Lucknow dated 12.082025 in Original Application No. 332/00185 of 2022 Anil Kumar Pal V/s Union of India and other contained as Annexure No.4 to the writ petition.
Issue notice to respondent no.1.
It has been submitted by learned counsel for the petitioner that the learned Central Administrative Tribunal failed to correctly appreciate the import of the judgment rendered by the Hon'ble Supreme Court in Union of India & Others v. K. V. Jankiraman & Others, (1991) 4 SCC 109 , which was a case where promotion was made solely on the basis of seniority. In the case of the respondent, however, promotion to the post of Senior Loco Pilot was on the criterion of seniority-cum-merit after passing the limited departmental examination.
For eligibility to participate in the limited departmental examination, two years' residency as Assistant Loco Pilot was required. Such residency, as per the circular, a copy of which has been filed as Annexure No. 1 to the petition, was to be actually completed before a

person could be entitled to participate in the selection for the post of Senior Loco Pilot.
Prima facie , we find that the matter requires consideration.
The petitioner shall take steps within a week both ways and file an affidavit of service within two weeks.
List on 27.11.2025.
Till the next date of listing, the impugned judgment and order shall remain stayed.
