Heard Mr. Manish Vaish, learned counsel for petitioners, learned State Counsel for opposite parties no.1 & 2 and Mr. R. K. Upadhyay, learned counsel for opposite party no.3.

Petition has been filed seeking following reliefs:-

"1. Issue a writ, order or direction in the nature of Certiorari quashing the impugned Recruitment Advertisement No.A-6/E-1/2025 dated 12.08.2025 (Annexure No.1), to the extent it prescribes under Clause 8, titled 'Educational Qualifications', Table Serial No.1, Column 3, Point (ii)-"Degree of Graduation in Education (B.Ed.) in a course recognized by NCTE"- as an essential qualification for the post of Lecturer in Government Inter College, without providing any transitional arrangement.

2. Issue a writ, order or direction in the nature of Mandamus commanding the respondents to permit the petitioners, who are presently pursuing the B.Ed. courses, to apply for and appear in the ongoing recruitment pursuant to Advertisement No.A-6/E-1/2025 dated 12.08.2025 (Annexure No.1) issued by Opposite Party No.3."

Learned counsel for opposite party no.3 on the basis of instructions submits that the advertisement has been issued in terms of U.P. Special Subordinate Academic Lecturer Cadre Service (IInd Amendment) Rules, 2024, which have not been challenged by

petitioners.

In view such submission, learned counsel for petitioners seeks to withdraw this petition with liberty to challenge the aforesaid Rules.

Considering aforesaid submission, petition is dismissed as withdrawn granting liberty to petitioners to file afresh in order to effect challenge to the Rules of 2024.
