This writ petition has been filed with the following prayers :-

(i) To issue a writ, order or direction in nature of mandamus commanding opposite parties No. 2 to the unauthorized and illegal 5 to remove encroachment and to remove the encroachment from the Prayagraj to Ayodhya National Highway No. 330 (old No.96) at Guptarganj Bazar (VillageDhesrua, Block- Kurebhar, Tehsil- Sadar, District-Sultanpur, in the interest of Justice.

(ii) To issue a writ, order or direction in nature of mandamus commanding opposite parties to frame and implement a permanent mechanism for regular monitoring and prevention of encroachments on National Highways in District Sultanpur.

(iii) To issue a writ, order or direction in nature of mandamus commanding opposite parties No. 2 to 5 to initiate the appropriate proceeding for recovering the Compensation for wrongfully occupying occup the Prayagraj to Ayodhya National Highway No. 330 (old No.96), at Guptarganj Bazar (Village Dhesrua, Block- Kurebhar, Tehsil- Sadar, District- Sultanpur.

It has been stated by the learned counsel for the petitioner that the petitioner is a resident of Village Dhesrua, Block Kurebhar, Tehsil Sadar, District Sultanpur, and he is a lawyer by profession, practising in the District Court, Sultanpur. Being a resident of the village, he is interested in the proper upkeep of Ayodhya National Highway No. 330 (Old No. 96), which is up to Prayagraj and which runs via Sultanpur. Sri Varun Pandey, learned counsel for the respondents, on the basis of written instructions received from the Executive Engineer, National Highway Division, PWD, Sultanpur, has stated that an antiencroachment drive was carried out on 01.08.2025 and again yesterday, i.e., on 01.12.2025 and the encroachments, which were temporary in nature, have been removed.

Let a short counter-affidavit be filed by respondent Nos.3 and 5 within two weeks.
