The instant application has been filed by the applicant with a prayer to set aside the order dated 29.10.2024 passed by District Judge/Session Judge, Jaunpur in Crl. Misc. Case No. 358 of 2024, under section 173(4) of BNSS read with 175(3) of BNSS, 2023, P.S. Sikrara, District Jaunpur and transfer the proceeding of Crl. Misc. Case No. 358 of 2024 from court of Chief Judicial Magistrate, Jaunpur to any other criminal court in the same session Division i.e. District Jaunpur Session Division.

The instant application is pending since November, 2024 i.e. for last almost a year.

Record further suggests that however, learned counsel for the applicant appeared on 17.1.2025 but on 7.2.2025 none was present on behalf of the applicant, therefore, it reflects applicant has lost his interest in the matter.

In view of the above, the instant transfer application stands dismissed for non prosecution .
