Heard learned counsel for the applicant and learned AGA for the State.

By means of this application, the applicant is seeking transfer of Criminal Case No.466 of 2018 (Smt. Anshu Singh v. Vikram Singh), under Section 125 Cr.P.C., Police Station- Shivpur, District- Varanasi, pending in the court of Additional Principal Judge, Family Court No.1, Varanasi to some other court of competent jurisdiction at Allahabad.

Concededly, the applicant-wife has filed three cases at Varanasi, arising out of her matrimonial dispute with the opposite party no.2, but she prayed for transfer of maintenance case filed under Section 125 Cr.P.C. on the sole ground that husband is represented by his sister, who is an advocate. According to learned counsel, the prayer for interim maintenance is not being considered by the trial court only because of the influence of applicant's sister-in-law.

This Court does not find merit in the sole ground raised for transfer. Merely because husband's sister is an advocate, it cannot be said that she is influencing the court. The allegation in this regard is vague and without any supporting material, therefore, no case is made out for transfer of the case.

The application is, accordingly, dismissed .
