Heard Shri Himanshu Mishra, learned counsel for the applicants and Shri Imran Khan, learned A.G.A. for the State.

The instant transfer application has been filed by the applicants with a prayer to transfer the Criminal Case No. 1741/2022 (State Vs Paras Uttam and Others), arising out of Case Crime No.365/2022, under Sections 498A, 323, 325 and 506 IPC r/w Section 3/4 Dowry Prohibition Act, Police Station Baheri, District Bareilly pending in the court of Judicial Magistrate, Baheri, District Bareilly to District & Sessions Court, Bareilly having competent jurisdiction.

At the very outset, learned counsel for the applicants submits that instant transfer application has been filed with a prayer to transfer the case lying before outlying court Baheri, District Bareilly to any other court in the same judgeship but instant transfer application has been filed without approaching the Sessions Court. Therefore the instant transfer application may be dismissed as withdrawn with liberty to the applicants to approach appropriate forum.

Learned A.G.A. has no objection.

In view of the above, the instant transfer application is dismissed as withdrawn with liberty as prayed.
