Applicant has filed this application under Section 447 Bhartiya Nagrik Suraksha Sanhita, 2023 seeking transfer of Special Session Trial No.354 of 2018, titled State vs. Dharmendra Nath Mishra, arising out of case crime no.177 of 2018, under Sections 419, 420, 406, 323, 504, 506 IPC and 3(1)(Da) and 3(1)(Dha) of SC/ST (Prevention of Atrocities) Act, 1989, registered at Police Station Khalilabad, District Sant Kabir Nagar, pending in the court of Special Judge (SC/ST Act), Sant Kabir Nagar to any other district.

Transfer of the trial is being sought on the ground that the opposite party no.3 is influential person, who may effect the pending trial proceedings.

Concededly, the prosecution evidence is complete and the case is fixed for defence evidence.

No ground is made out to transfer the case. The application is dismissed.
