Applicant has filed this application under Section 447 of Bhartiya Nagarik Suraksha Sanhita, 2023 for transfer of Case No.155 of 2024; titled : State Vs. Anjali and others , Under Sections 147, 323, 504, 506, 325 and 452 I.P.C. from Court of Judicial Magistrate, 1st, Fatehabad, Agra to any other competent Court of jurisdiction in District Meerut.

Learned counsel for the applicants has argued that the applicant no.1 is mother of opposite party no.3 as well as mother-in-law of opposite party no. 4 who are residing at Agra, and the other cases between the parties are pending at District Court, Meerut, therefore, it is prayed that the above mentioned case which is pending trial at Agra be also transferred to district Meerut, as the applicant no.1 is an old lady who is suffering from age related health issues.

During the course of hearing, it is not disputed that the other cases relate to the matrimonial dispute of opposite party no.2- Anjali with her husband- Deepak, and the cases relating to the maintenance, Domestic Violence Act or prosecution under Section 498A I.P.C. etc. relate to the husband and in-laws of opposite party no.2, wherein the applicant no.1 is not a party. No other sufficient ground has been made out by the applicants for transfer of the

case.

The application is dismissed.
