1. Heard Sri Virendra Kumar Gautam, Advocate holding brief of Sri Baleshwar Chaturvedi, learned counsel for the appellant and Sri Ratnesh Nandan Singh, learned A.G.A. for the State.

2. The instant criminal appeal has been filed by the appellant against the judgment and order dated 05.07.2025 passed by Special Judge (E.C. Act)/Additional Sessions Judge, Agra in Case No. 2637 of 2019 (State of U.P. vs. Mukut Singh) arising out of F.I.R. No. 454 of 2016 under Section 135 of the Electricity Act, 2003, P.S.- Dauki, District- Agra.

The allegation against the respondent no. 2 is that he was found during routine checking by the Electricity Department that he was illegally running the Grass Cutter Machine of one horsepower on 27.09.2018 at around 1:00 PM. Thereupon, on the complaint of the Junior Engineer, Santosh Soni, the F.I.R. being Case Crime No. 454 of 2018 under Section 135 of the Electricity Act was registered against the respondent no. 2.

4. After investigation, the charge-sheet was filed and the trial was conducted. During the trial, the trial court has recorded the findings that the Electricity Department has failed to provide any record with regard to the raid conducted by the Electricity Department and any material seized by them during such process from the premises of the respondent no. 2. The Electricity Department has failed to produce any document or any

material with regard to the illegal electricity connection used by the respondent no. 2, nor any photograph and video of the same. Therefore, for want of any material against the respondent no. 2, the trial court has acquitted respondent no. 2 for the charge-sheet under Section 135 of the Electricity Act.

5. The relevant observations of the trial court reads as under:

"13. प्रस्तुत मामले में अिभयुक्त के िवरूद्ध िदनांक 27.09.2018 को समय 13.00 बजे वस्थान रामस्वरूप की मिढ़या, महल की ठार, कॉकरपुर, थाना डौकी, आगरा में िवद्युत चैिकग िकए जाने के दौरान अवैध रूप से एल०टी०लाइन पर किटया डालकर िवद्युत उपयोग कर िवद्युत चोरी िकए जाने का आरोप है।

प्रस्तुत प्रकरण में अिभयुक्त पक्ष की ओर से यह तकर् िदया गया है िक प्रस्तुत मामले में िदनांक 27.09.2018 को िवद्युत िवभाग की टीम द्वारा चैिकग करना बताया गया है िकन्तु चैिकग की कोई वीिडयोग्राफी या फोटोग्राफी उपलब्ध नहीं है। िवद्युत िवच्छेदन के सम्बन्ध में भी कोई प्रपत्र पत्रावली पर दािखल नहीं िकए गए है। चैिकग स्थल से बरामद केिवल व अन्य माल को भी न्यायालय में प्रस्तुत नहीं िकया गया है। िकसी भी स्वतन्त्र साक्षी को भी परीिक्षत नहीं कराया गया है। उक्त आधारो पर अिभयुक्त दोष मुक्त िकए जाने योग्य है।

प्रस्तुत मामले में परीिक्षत साक्षी पी०डब्लू०-01 अवर अिभयन्ता संतोष सोनी ने अपनी िजरह में कथन िकया है िक अिभयुक्त मुकुट िसह मौके पर नहीं िमले थे। उसने शान्ती व्यवस्था बनाए रखने के िलए चैिकग के दौरान केिवल व अन्य उपकरण कब्जे में नहीं िलया गया था। यह कहना सही है िक उसने उपरोक्त प्रकरण में कोई माल बरामद कर थाना में दािखल नहीं िकया था।

प्रस्तुत मामले में परीिक्षत साक्षी पी०डब्लू0-02 गजेन्द्र िसह टीजी-2 ने अपनी िजरह में कहा है िक यह सही है िक टीम ने कोई संयोजन से सम्बिन्धत केिवल, चारा कूटने की मशीन आिद बरामद नहीं की थी।

साक्षी पी०डब्लू03 उपिनरीक्षक कणर् िसह ने अपनी िजरह में कथन िकया है िक उसने घटना स्थल से िवद्युत उपकरण बरामद नहीं िकए थे।

प्रस्तुत प्रकरण में िदनांक 27.09.2018 को रामस्वरूप की मिढ़या, महल की ठार, कांकरपुर थाना डौकी में की गयी चैिकग में अिभयुक्त मुकुट िसह के यहाँ चैिकग करना बताया

गया है। उक्त चैिकग के दौरान चैिकग टीम द्वारा अिभयुक्त मुकुट िसह द्वारा एल०टी० लाइन पर किटया डालकर िवद्युत चोरी करते पाए गए।

अिभयुक्त के िवद्वान अिधवक्ता का यह भी तकर् है िक बरामद माल या िकसी अन्य उपकरण को कोटर् में पेश नहीं िकया गया है न ही बरामदगी की कोई फदर् तैयार की गई है, िजससे उपरोक्त घटना 'व बरामदगी संिदग्ध हो जाती है। वादी द्वारा प्रस्तुत तहरीर में यह अंिकत है िक चैिकग के समय अिभयुक्त द्वारा किटया डालकर 1 एच०पी० की चारा कूटने की मशीन िबना िकसी संयोजन के चलाते हुए पाया गया। साक्षी पी०डब्लू०1 द्वारा अपनी िजरह में कथन िकया गया है िक उसने शान्ती व्यवस्था बनाए रखने के िलए चैिकग के दौरान केिवल व अन्य उपकरण कब्जे में नहीं िलया गया था। यह कहना सही है िक उसने उपरोक्त प्रकरण में कोई माल बरामद कर थाना में दािखल नहीं िकया था। साक्षी पी०डब्लू02 ने अपनी िजरह में कथन िकया है िक यह सही है िक टीम ने कोई संयोजन से सम्बिन्धत केिवल, चारा कूटने की मशीन आिद बरामद नहीं की थी। साक्षी पी०डब्लू० 3 ने अपनी िजरह में कथन िकया है िक उसने घटना स्थल से िवद्युत उपकरण बरामद नहीं िकए थे। इस प्रकार उपरोक्त सािक्षयो के अिभकथनों से स्पष्ट है िक घटना स्थल से न तो कोई केिवल या अन्य उपकरण बरामद िकए गए है और न ही िकसी िवद्युत उपकरण को न्यायालय में प्रस्तुत कराया गया है और न ही उनकी कोई फदर् ही तैयार की गई है। बरामद माल को न्यायालय में प्रस्तुत न िकए जाने से उसकी बरामदगी संिदग्ध हो जाती है। इस आधार पर अिभयुक्त के िवद्वान अिधक्ता के उपरोक्त तकर् पर बल िमलता है िक माल बरामदगी संिदग्ध प्रतीत होती है।

अिभयुक्त के िवद्वान अिधवक्ता का यह भी तकर् है िक घटना की वीिडयोग्राफी न्यायालय में प्रस्तुत नहीं की गई है तथा प्रस्तुत चैिकग िरपोटर् की मूल प्रित प्रस्तुत नहीं की गई है िजससे घटना संिदग्ध प्रतीत होती है। साक्षी पी०डब्लू01 व पी०डब्लू02 द्वारा अपने साक्ष्य में चैिकग िरपोटर् तैयार व उस पर कमर्चारीगण के हस्ताक्षर होने का कथन िकया गया है। िकन्तु मूल चैिकग िरपोटर् न्यायालय में प्रस्तुत नहीं की गई है और न ही मूल चैिकग िरपोटर् के सम्बन्ध में कोई कथन िकए गए है। वीिडयोग्राफी से सम्बिन्धत कोई भी सी०डी० या फोटो आिद पत्रावली पर उपलब्ध नहीं है। िजससे यह स्पष्ट है िक वीिडयोग्राफी को न्यायालय में प्रस्तुत नहीं िकया गया है और न ही चैिकग िरपोटर् की मूल प्रित दािखल है। उपरोक्त आधारो पर अिभयुक्त के िवद्वान अिधवक्ता के उपरोक्त तकर् पर बल पाया जाता है िक वीिडयोग्राफी के अभाव में तथा चैिकग िरपोटर् की मूल प्रित न्यायालय में उपलब्ध न होने से मामला संिदग्ध प्रतीत होता है।

अिभयुक्त के िवद्वान अिधवक्ता का यह भी तकर् है िक घटना के िदनांक को अिभयुक्त के साथ-साथ छः अन्य व्यिक्तयो के यहाँ चैिकग की गई थी तथा उनके भी कनेक्शन कांटे गए थे िकन्तु गांव के लोगो में से िकसी को भी चक्षुदशीर् साक्षी के रूप में परीिक्षत नहीं कराया गया है,

िजससे घटना संिदग्ध हो जाती है। साक्षी पी०डब्लू01 द्वारा अपने साक्ष्य में कथन िकया गया है िक घटना के िदनांक को उसने व टीम ने अन्य लोगो के यहाँ भी चैिकग की थी। तहरीर में स्थान रामस्वरूप की मिढ़या, महल की ठार, कांकरपुरा, डौकी में कुल 07 लोगो के यहाँ चैिकग करना बताया गया है। साक्षी पी०डब्लू02 ने अपने साक्ष्य में कथन िकया है िक उसी िदन अन्य 06 लोगो के यहाँ भी चैिकग की गई थी। इस प्रकार यह स्पष्ट है िक स्थान रामस्वरूप की मिढ़या, महल की ठार, कांकरपुरा, डौकी में अिभयुक्त के अितिरक्त अन्य छः लोगों के यहाँ चैिकग की गई तथा कनेक्शन कांटे गए थे िकन्तु घटना के समय िकसी भी गांव के व्यिक्त को चक्षुदशीर् साक्षी नहीं बनाया गया और न ही िकसी को परीिक्षत कराकर घटना को सािबत कराया गया है। उपरोक्त आधारो पर अिभयुक्त के िवद्वान अिधवक्ता के उपरोक्त तकर् पर बल पाया जाता है िक चक्षुदशीर् सािक्षयों के साक्ष्य के अभाव में घटना संिदग्ध प्रतीत होती है।

क इस प्रकार पत्रावली पर अिभयोजन पक्ष की ओर से अपने कथानक की पुिष्ट व समथर्न हेतु मौके की कोई फोटोग्राफी या वीिडयो आिद भी दािखल नहीं िकया गया है जो मामले के तथ्यों को देखते हुए अिभयोजन कथानक की पुिष्ट व समथर्न हेतु एक महत्वपूणर् साक्ष्य िसद्ध हो सकता था। अिभयोजन की ओर से मौके के सािक्षयों को भी परीिक्षत नहीं कराया गया है न ही वैचैिकग िरपोटर् की मूल प्रित दािखल है, केिवल व अन्य िवद्युत उपकरण की बरामदगी के सम्बन्ध में कोई फदर् िरपोटर् पत्रावली पर उपलब्ध नहीं है। केिवल व अन्य उपकरणों को बरामद कर न्यायालय में प्रस्तुत नहीं िकया गया है। इस प्रकार चैिकग के समय मौके पर अिभयुक्त की उपिस्थित के तथ्य को भी स्पष्ट साक्ष्य के माध्यम से प्रदिशत नहीं िकया जा सका है, िजससे यह दिशत हो सकता था िक मौके पर अिभयुक्त को अवैध रूप से किटया डालकर िवद्युत उपयोग करते हुए पाया गया था। चैिकग टीम द्वारा राजस्व िनधा र ्ण से सम्बिन्धत कोई अिभलेख िववेचक को िदया गया अथवा नहीं यह स्पष्ट नहीं होता है। इस प्रकार िववेचक द्वारा राजस्व िनधा र ्ण प्रपत्र की प्रित प्राप्त हुए िबना ही तथा उनका अवलोकन िकए िबना ही मामले में आरोप पत्र प्रस्तुत कर िदया जाना प्रदिशत होता है।

अिभयोजन की ओर से इस मामले के यद्यिप िववेचक /िद्वतीय साक्षी/औपचािरक साक्षी द्वारा अिभयोजन प्रपत्रों की औपचािरक सत्यता को सािबत िकया गया है िकन्तु मात्र अिभयोजन प्रपत्रों को सािबत कर देने से अिभयुक्त की दोषीता सािबत नहीं होती है।"

6. Learned counsel for the appellant submits that during the heavy protest, no material could be collected on the spot. Therefore, the same could not be produced before the trial court.

7. It is a settled position of law that the High Court should not interfere in the well reasoned order of the trial court, which has been arrived at after proper appreciation of the evidence in an appeal against acquittal. The

High Court should gave due record to the findings and the conclusions reached by the trial court, unless strong and compelling reasons exist in the evidence itself which can dislodge findings recorded by the trial court. Since, the counsel for the appellant has failed to bring on record any material or any compelling reason with regard to the existence of evidence, which can dislodge the findings recorded by the trial court.

For the aforesaid facts and circumstances, since there is no material available on record, as is admitted by learned counsel for the appellant, to support the allegations of illegal electricity theft by the respondent no. 2, accordingly, the instant appeal is devoid of merit and the same is accordingly dismissed .
