Appellant-complainant has filed this appeal under section 413 of B.N.S.S. seeking leave to appeal to challenge the impugned order dated 21.04.2025 passed by Chief Judicial Magistrate, Hapur in Criminal Case No. 102009 of 2016, titled : State of U.P. v. Gaurav @ Ajay arising out of Case Crime No.149 of 2016, under Sections 323, 325, 504 I.P.C., Police Station Hapur Dehat, District Hapur whereby the trial court has acquitted the accused-respondent nos.2.

When confronted with the maintainability of the appeal against the impugned judgement of acquittal dated 21.04.2025 passed in the trial arising out of Case Crime No.149 of 2016, learned counsel for the appellant prays for withdrawal of the appeal to file the same before the appropriate Court.
