Heard Sri Mohd. Afzal alongwith Sri Sarthak Gupta, learned counsel for the applicant and Sri Nitesh Kumar Srivastava, learned counsel for the State.

Present application has been moved seeking anticipatory bail in Case Crime No.255 of 2023, under Sections 420, 467, 468, 471 and 120B IPC, Police Station Noida Sector-20, District Gautam Buddha Nagar with the prayer that in the event of arrest, applicant may be released on bail.

It is contended by the learned counsel for the applicant that the name of the applicant has been surfaced in the confessional statement of the co-accused. It is also submitted that one of the co-accused has already been granted anticipatory bail by the Hon'ble Supreme Court and the other co-accused persons have been granted regular bail by the Hon'ble Court Supreme Court.

Learned AGA prays for some time to file a short counter affidavit and it has been submitted by him that proclamation has been issued against the applicant and he moved the learned trial court thrice for grant of anticipatory bail and even after issuance of proclamation the applicant has moved the sessions
