Counsel for the applicant urged innocence and implication out of enmity, absence of credible evidence and of any coercive step, that no suicide note was recovered, that investigation was pending with the chargesheet not yet filed, and a clean criminal history, with an undertaking to cooperate; the learned G.A. opposed, contending a probable role for the accused. वतर्मान दािण्डक प्रकीणर् अिग्रम जमानत प्राथर्ना पत्र, आवेदक की ओर से मु०अ०सं० 561/2024, अन्तगर्त धारा 108 बी.एन.एस., थाना कोतवाली हाटा, िजला कुशीनगर में अिग्रम जमानत की मॉग करते हुए इस प्राथर्ना के साथ योिजत िकया गया है िक िगरफ्तारी की िस्थित में आवेदक को जमानत पर िरहा िकया जा सके।

आवेदक के िवद्वान अिधवक्ता एवं िवद्वान अपर शासकीय अिधवक्ता को सुना तथा पत्रावली का पिरशीलन िकया।

आवेदक के िवद्वान अिधवक्ता ने तकर् प्रस्तुत िकया िक आवेदक िनदोर्ष है, उसे उपरोक्त धाराओं में द्वेषवश तंग व परेशान करने की िनयत से आिलप्त िकया गया है, उसे आशंका है िक उसे उपरोक्त विणत मामले में िगरफ्तार िकया जा सकता है जबिक उसके िवरूद्ध कोई िवश्वसनीय साक्ष्य नहीं है और आवेदक के िवरूद्ध अभी कोई भी बाध्यकारी प्रिक्रया नहीं अपनाई गयी है। आवेदक द्वारा ऐसा कोई भी कृत्य कािरत नहीं िकया गया है, जैसािक प्राथिमकी में विणत िकया गया है। आवेदक द्वारा सूचनाकतार् की पुत्री (मृतका) को शारीिरक एवं मानिसक रूप से प्रतािड़त व परेशान नहीं िकया गया, न ही जहरीला पदाथर् खाने एवं आत्महत्या कािरत करने हेतु उत्प्रेिरत िकया है। उक्त किथत घटना के संबंध में मृतका द्वारा िलिखत कोई सुसाइड नोट नहीं पाया गया है। वतर्मान वाद में िववेचना प्रचिलत है तथा आरोपपत्र अभी तक संबंिधत िवचारण न्यायालय में दािखल नहीं िकया गया है। आवेदक का कोई पूवर् आपरािधक इितहास नहीं है। पुनः उनका कथन है िक आवेदक िवचारण और जॉच के दौरान सहयोग करने का वचन देता है िक वह जॉच एजेंसी या न्यायालय द्वारा अपेिक्षत समय पर उपिस्थत रहेगा एवं आवेदक की ओर से यह आश्वासन िदया गया है िक वह कानून की प्रिक्रया में सहयोग करने के िलए तैयार है और जब भी आवश्यकता होगी वह ईमानदारी से न्यायालय के समक्ष खुद को उपलब्ध कराएगा और उन सभी शतोर्ं को स्वीकार करने के िलए भी तैयार है, जो न्यायालय उस पर अिधरोिपत करेगी।

िवद्वान अपर शासकीय अिधवक्ता द्वारा अिभयुक्त के अिग्रम जमानत के िवरोध में यह तकर् प्रस्तुत िकया गया िक इस मामले में अिभयुक्त की भूिमका पिरलिक्षत हो रही है तथा इस घटना में इनकी भूिमका संभाव्य है। इसिलए अिभयुक्त को अिग्रम जमानत पर मुक्त न िकया जाय।

यह कहा जा सकता है िक Siddharam Satlingappa Mhetre vs. State of Maharashtra, (2011) 1 SCC 694 के मामले में माननीय उच्चतम न्यायालय द्वारा यह अवधािरत िकया गया है िक अिग्रम जमानत यािचका पर न्याय-िनणर्यन करते समय न्यायालय को आरोपों की प्रकृित और गंभीरता, आरोपी की न्याियक प्रिक्रया से भागने की संभावना पर िवचार करना चािहए और यह िक न्यायालय को आरोपी के िवरूद्ध उपलब्ध सभी सामग्री का सावधानी से मूल्यांकन करना चािहए और आरोपी की वास्तिवक भूिमका पर भी िवचार करना चािहए।

उभय पक्ष के तकोर् एवं वतर्मान मामले में अिग्रम जमानत संबंधी िविध के स्थािपत िसद्धांतों को ध्यान में रखते हुए और पक्षकारों के िवद्वान अिधवक्ताओं के कथनों, आरोपों की प्रकृित, आवेदक की भूिमका और मामले के सभी तथ्यों एवं पिरिस्थितयों को ध्यान में रखते हुए, मामले के गुण-दोष पर िबना कोई िवचार व्यक्त िकए अिग्रम जमानत की प्राथर्ना स्वीकार िकए जाने योग्य है।

तद्नुसार, यह अिग्रम जमानत आवेदन पत्र स्वीकार िकया जाता है।

उपरोक्त मुकदमा अपराध संख्या में सिम्मिलत आवेदक की िगरफ्तारी की दशा में, उसे संबंिधत थाने के भारसाधक अिधकारी की संतुिष्ट पर रू० 50,000/- का व्यिक्तगत बंध पत्र एवं उसी धनरािश के दो प्रितभू प्रस्तुत करने पर , पुिलस आख्या दािखल िकए जाने तक िनम्न शतोर् के अधीन अिग्रम जमानत पर मुक्त िकया जाएगा :-

i) आवेदक अिभयोजन पक्ष के साक्ष्यों के साथ छेड़छाड़ नहीं करेगा।

ii) आवेदक अिभयोजन पक्ष के गवाहों को धमकाएगा या परेशान नहीं करेगा।

iii) आवेदक, यिद आवश्यक होगा तो पुिलस अिधकारी के समक्ष जॉच हेतु अपेिक्षत प्रत्येक ितिथ एवं िनयत समय पर उपिस्थत रहेगा तथा अनावश्यक स्थगन नहीं लेगा।

iv) आवेदक उस अपराध के समान कोई अपराध नहीं करेगा, िजसका आरोप आवेदक पर लगाया गया है या िजसके िकए जाने का संदेह है।

v) आवेदक मामले के तथ्यों से पिरिचत िकसी व्यिक्त को प्रत्यक्ष या अप्रत्यक्ष रूप से कोई प्रलोभन, धमकी या वादा नहीं करेगा िजससे वह व्यिक्त न्यायालय या िकसी पुिलस अिधकारी के समक्ष तथ्यों का खुलासा करने से िवमुख हो जाए या साक्ष्यों के साथ छेड़छाड़ करे।

उपरोक्त शतोर् के उल्लंघन की िस्थित में अिभयोजन पक्ष को, आवेदक को प्रदत्त अिग्रम जमानत के िनरस्तीकरण हेतु उपयुक्त आवेदन प्रस्तुत करने की स्वतंत्रता होगी।
