The applicant sought anticipatory bail in F.I.R./Case Crime No. 433 of 2022 under Section 307 IPC, Police Station Simbhawali, District Hapur; his earlier anticipatory bail application had been dismissed by the court below vide order dated 01.05.2025. Heard Sri Ved Prakash Singh, learned counsel for the applicant and learned A.G.A. for the State.

The present anticipatory bail application has been filed on behalf of the applicants in F.I.R./Case Crime No. 433 of 2022, under Section 307 IPC, Police Station Simbhawali, District Hapur, with a prayer to enlarge them on anticipatory bail.

Learned counsel for the applicants has submitted that the anticipatory bail application of the applicant was dismissed by Court below vide order dated 01.05.2025. There is no specific allegation made against the applicant only general allegation has been assigned to the applicant. Applicant has no other criminal history. It is submitted that co-accused namely Mahesh Chand and Ravindra Kumar has already been granted interim anticipatory bail vide order dated 29.5.2025 passed by co-ordinate Bench of this Court in Crl. Misc. Anticipatory Bail Application u/s 482 BNSS no. 3999 of 2025 and as such applicant also seeks parity with same.

Considering order dated 29.5.2025 passed in Anticipatory Bail Application no. 3999 of 2025, matter requires consideration.

In the event of arrest, the accused-applicant- Sachin , shall be released forthwith in the aforesaid case crime (supra) on interim anticipatory bail on furnishing a personal bond and two sureties each in the like amount to the satisfaction of the arresting officer/investigating officer/S.H.O. concerned on the following conditions:-

(i) the applicant shall make himself available for interrogation as and when required;

(ii) the applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any police officer; and

(iii) the applicant shall not leave India without the previous permission of the Court.

Two weeks' time is granted to learned counsel for the informant to file counter affidavit. Learned AGA may also file counter affidavit within the said period.

Rejoinder affidavit, if any, may be filed within a week, thereafter.
