The present anticipatory bail application has been filed seeking anticipatory bail in FIR No.298/2025, under Sections 3(1) U.P. Gangsters and Anti-Social Activities (Prevention) Act, Police Station- Dhanepur, District-Gonda.

Heard learned counsel for the applicant and learned A.G.A. for the State.

Learned counsel appearing on behalf of the applicant submits that in the solitary case shown against the applicant in the gang chart, the applicant has already been enlarged on bail. The said bail order is on record as Annexure No. 4 to the bail application. It is further submitted that, apart from the aforesaid case mentioned in the gang chart, the applicant has criminal antecedents relating to six other cases, the details of which have been duly disclosed in paragraph 11 of the bail application.

Learned counsel for the applicant further submits that if the accused is granted anticipatory bail, he undertakes to comply with all conditions imposed by the Court. He shall fully cooperate with the investigation and shall not misuse the liberty granted to him.

Per contra, learned AGA has opposed the anticipatory bail application, contending that the applicant has a chequered criminal history involving six additional cases, apart from the solitary case mentioned in the gang chart. It

is submitted that all the said cases are of a similar nature and pertain to offences under the U.P. Prevention of Cow Slaughter Act. It is further submitted that even the base case reflected in the gang chart arises under the provisions of the U.P. Prevention of Cow Slaughter Act. On the basis of the repeated involvement of the applicant in similar offences, it is urged that the applicant appears to be a habitual offender and, therefore, does not deserve the discretionary relief of anticipatory bail.

Upon due consideration of the rival submissions and having regard to the long criminal history of the applicant involving six prior cases of a similar nature, this Court is not inclined to extend the extraordinary relief of anticipatory bail to the applicant.

Accordingly, the anticipatory bail application is dismissed .
