The present anticipatory bail application has been filed seeking anticipatory bail in Case Crime No.277 of 2025 under Section 75(2),(3), 333, 351(3) BNS and Section 7/8 POCSO Act, Police Station Gauriganj, District Amethi.

Heard learned counsel for the applicant and learned Additional Government Advocate for the State.

As per the instructions of learned A.G.A. notices to respondent no.2/complainant has already been served, however, no one has appeared on behalf of the complainant.

Submission of learned counsel for the applicant is that the chargesheet in this case has already been submitted. The applicant is a juvenile. Learned counsel for the applicant has drawn the attention of this Court to the marksheet of the applicant as well as the statement recorded by the Investigating Officer treating him as a juvenile. He submits that the offence is punishable with imprisonment up to seven years. Learned counsel for the applicant further undertakes that the applicant shall cooperate in the trial.

Learned Addl. Government Advocate has opposed the prayer made by applicant's counsel.

On due consideration to the fact that the applicant has no criminal antecedents; the undertaking given on behalf of the applicant that he shall cooperate in the trial; charge sheet has been filed, the offence is punishable with seven years as also the judgment of Supreme Court in Musheer Alam versus The State of U.P. and another 2025 SCC OnLine SC 116 and without entering into the merit of the case, it would be appropriate to grant protection to the applicant.

In view of the above, it is provided that the applicant shall surrender before the concerned court within 20 days from the date of receipt of a certified copy of this order. On such surrender, the applicant shall be released on anticipatory bail on his furnishing a personal bond and two sureties of the like amount to the satisfaction of the trial court with the following conditions:-

The applicant shall cooperate in the trial and he will not influence the witnesses.

The applicant shall not leave India without previous permission of the Court.

¶20

Any other condition which the trial court may deem fit and proper may also be imposed.

¶21

In case of default, it would be open for the trial court to proceed in accordance with law.

The application is allowed accordingly.
