Heard learned counsel for the applicant and learned Additional Government Advocate for the State.

The present anticipatory bail application has been filed for grant of anticipatory bail as the accused-applicant is apprehending his arrest in connection with Case Crime No.0584 of 2023, under Sections 498A, 304B IPC and 3/4 Dowry Prohibition Act, Police Station Meja, District Prayagraj.

Learned counsel for the applicant submits that the applicant has been falsely implicated in the present case just to harass the applicant. The applicant has never committed any offence as alleged in the impugned FIR. The applicant is the brother-in-law of the deceased. At the time of incident, the applicant was residing at Gujarat for earning his livelihood. The FIR is highly delayed about 14 days for which no plausible of explanation has been mentioned. He further submits that neither the applicant has demanded for additional dowry nor he harassed the deceased. Only general allegation has been levelled against the applicant. The deceased herself has consumed poisonous substance. He further submits that applicant's family member and informant have entered into compromise outside the Court stating therein that he does not wish to pursue the FIR further and also does not intend to appear before the Court. The allegations, as contained in the prosecution case, are nothing but a tissue of lies having been brought forth with the sole intention to harass the applicant. He further submits that similarly placed co-accused Darbari Lal Jaisal and Smt. Saroj Devi, who are father-in-law and mother-in-law, have already been granted anticipatory bail by this Court vide orders dated 23.04.2024 and 13.11.2024 passed in Criminal Misc. Anticipatory Bail Application Nos.3981 and 11010 of 2024, copy of bail orders has been annexued as Annexure No.4 to the affidavit. The

applicant is having no previous criminal history.

Learned A.G.A. has opposed the prayer for anticipatory bail of the applicant and has submitted that applicant is named in the impugned FIR and as per version of the FIR, there is a clear cut allegation against the applicant. Just after six month of marriage of the deceased, the deceased was murdered. Prima facie offence as alleged in the impugned FIR is made out against the applicant and in view of the seriousness of the allegations made against the applicant, he is not entitled to grant of anticipatory bail.

Considering the facts and circumstances of the case as well as submissions advanced by learned counsel for the parties and from the perusal of material on record and also taking into consideration the gravity of accusation and there being possibility of their fleeing from justice, without expressing any opinion on the merits of the case, the applicant is not entitled to be released on anticipatory bail. Accordingly, the prayer for grant of anticipatory bail to the applicant is refused, consequently, the present anticipatory bail application is rejected .
